The Parsnip Service Terms and Conditions

Definitions

Agreement: means these terms and conditions as varied by Us from time to time;

Care: means the help available to deal with Your Parsnip Service related queries. You may contact the Care team via email using care@getparsnip.com;

Cashback: As a Donor, when You complete a qualifying Transaction at a participating Retailer, You generate cashback, a cash benefit based on Your spend that is paid back to You;

Cashback Account: means an electronic wallet operated by Your Payment Service Provider that holds Your Cashback. You can access this electronic wallet in the Mobile App in the ‘My Rewards’ section;

Charity: means a charity registered with either the Charity Commission of England and Wales; the Charity Commission of Northern Ireland; or the Office of the Scottish Charity Regulator; and that has provided all the necessary documentation required to be deemed up-to-date by the Charity Commission;

Donor: You become a Donor when You select a Charity to support and switch on Your Micro-Donations

Donation-Boost: when You generate Cashback, have selected Charities to support, and selected to give Donation-Boosts, You agree that half of any Cashback generated will be donated as a Donation-Boost to Your selected Charities. If You have elected not to give Donation-Boosts, all of Your Cashback will be paid to You.

Gift-Aid: allows the Charities You support to do even more for society. Gift Aid is a UK government scheme that allows You to increase the value of Your Micro-Donations by 25% at no cost to You;

Micro-Donation: means the amount of money You agree to donate to Your supported Charities using the Parsnip Service when You complete a Transaction with a Retailer. You agree that Rokami can transfer Your Micro-Donations to Your selected charity(s);

Mobile App: means the RingPay mobile application provided by Your Payment Service Provider, that You use to access the Parsnip Service. Your Mobile App displays information about Your usage of the Parsnip Service, as well as allowing You to change Your Parsnip Service settings and preferences. You will need an active internet connection to access it;

Payment Account: means an electronic wallet operated by Your Payment Service Provider that holds the funds You spend as You complete Transactions using Your Payment Device. You can see how much money You have available to spend from this electronic wallet in the Mobile App;

Payment Service Provider: means PayrNet Limited (authorised and regulated by the Financial Conduct Authority with FCA firm reference number 900594) (‘PayrNet’), and McLEAR Ltd (Company Number 08308520) which is an e-money distributor and co-brand partner of PayrNet(‘McLEAR’). PayrNet’s registered office is Kemp House, 142 City Road, London, UK, EC1V 2NX. McLear’s registered office is Steel House, Alexander Place, 13-17 Princes Road, Richmond, Surrey, TW10 6DQ;

Payment Device: means the payment Ring, or some such other form-factor, provided by Your Payment Service Provider to effect Transactions;

Parsnip Service: means the fundraising service offered to You by Rokami and Our associated third-party suppliers;

Retailer: means a merchant, or any other person, firm, or corporation, that fulfils Transactions;

RingPay Giving and RingPay Rewards: are the brand names chosen by McLEAR, Your Payment Service Provider, for certain Parsnip Service functions;

Rokami, We, Us, or Our: means Rokami Ltd whose registered office is St Michaels Shinfield Road, Shinfield, Reading, Berkshire, England, RG2 9BE, or any of its wholly owned subsidiaries;

Transaction: means a retail sale completed by You with a Retailer using Your Payment Device;

Website: means Our website getparsnip.com and any sub-domains of this site unless expressly excluded by their own terms and conditions;

You, My: means the person entering into this Agreement with Us.

Registering and using the Parsnip Service

  1. You agree that Your use of the Parsnip Service is regulated by the terms set out in this Agreement, and You agree to use the Parsnip Service at all times in a responsible and legal manner, and in a way that does not bring the Parsnip Service into disrepute.
  2. When You register for the Parsnip Service, You select which Charities You wish to support; set Your donation rules; set Your marketing consents; and set Your Gift Aid declaration status. You may change which Charities You support, Your donation rules, or Your marketing consent using the Mobile App. If You change which Charities You support, the change will take effect from the first of the next month. If You change Your donation rules, or Your marketing consent, the change will take effect immediately. If You make a Gift Aid declaration, Rokami will provide Your nominated Charities with the information they need to complete the Gift Aid collection process governed by HMRC. You can change Your Gift Aid declaration status at any time by contacting Our Care team via email using care@getparsnip.com.
  3. You may be given a referral code. If that referral code comes from a Charity and You redeem it, You agree to select that Charity as the sole beneficiary of Your Micro-Donations and Donation Boosts for a minimum period of six months. If You do not select the Charity that provided You with the referral code that You used, We reserve the right to select that Charity for You.
  4. As You complete a Transaction, We will process Your Transaction information, and based on Your donation rules, instruct Your Payment Service Provider to deduct the Micro-Donation amount from the available balance on Your Payment Account.
  5. The donation rules that let You to set the Micro-Donation amount per Transaction are:
    1. Round up My Transaction spend amount to the nearest whole pound (e.g. the Transaction spend amount is £1.88, so £0.12 is donated to Your nominated Charities); or
    2. Add a fixed amount of either £0.10, £0.20, £0.50, £1.00 or £2.00 to My Transaction spend amount (e.g the amount selected by the donation rule is the amount donated to Your nominated Charities.
  6. You may also apply a cap on the total amount of Micro-Donations given per calendar month of £3.00, £5.00, £10.00, £15.00, or £20.00. Alternatively, You can switch off Micro-Donations if You have none to give in any particular month. Any new donation rules added or amended over time will be available for selection by You as part of the registration process and in the Mobile App.
  7. The Parsnip Service also includes the ability for You to earn Cashback when You, as a Donor, buy something from certain Retailers. Your Mobile App shows which Retailers allow You to generate Cashback, which Transactions are ineligible, and any other conditions specified by the Retailer. Cashback is subject to the terms and conditions listed by each Retailer providing the Cashback.
  8. The Cashback generated is either a percentage of the amount that You, as a Donor, spent with the Retailer, or a fixed sum. For example, if You buy something for £40 with Cashback of 6%, You pay the Retailer £40, and £2.40 is credited to Your Cashback Account. We will process Your Transaction information to claim the Cashback that will then be credited by Your Payment Service Provider to the available balance on Your Cashback Account. Your Cashback transactions will appear in the ‘My Rewards’ section of the Mobile App as either \”earned\” or \”available\”. Once \”available\” the Cashback will be added automatically to the balance on Your Cashback Account, and can be transferred by You to Your Payment Account.
  9. When You consent, We will process Your Transaction information to create a Donation-Boost, which will be paid by Us to Your nominated Charities on Your behalf.
  10. It may take up to 100 days to process the Cashback and Donation-Boosts between Us, the Retailers, and the Payment Service Provider and confirm those total amounts to You.
  11. You can see the total amount of Micro-Donations You have donated to Your nominated Charities, and how much Cashback You have generated for Yourself in the Mobile App. We will let You know the amount of Donation-Boosts You have donated to Your chosen Charities by sending You an email as part of the Parsnip Service.
  12. If You support more than one Charity, You agree that Your Micro-Donations, and Your Donation-Boosts, will be split equally across Your supported Charities, allowing Your supported Charities to claim equal amounts of Gift Aid.
  13. Should You request a refund from the Retailer where You had previously completed a successful Transaction, You agree that Your original Micro-Donation made to Your nominated Charities will not be refunded to You.
  14. If You successfully complete a Transaction using Your Payment Device, but there are insufficient funds available to give the Micro-Donation, the Micro-Donation will not be collected.
  15. We transfer Micro-Donations and Donation-Boosts to the respective Charities on a quarterly basis to avoid unnecessary administration at the Charities.
  16. The Parsnip Service supports all Charities in the United Kingdom. We do however reserve the right to remove a Charity from the Parsnip Service at any time. If We remove a Charity that You are supporting, We will ask You to select a replacement Charity. If You do not wish to select a replacement Charity, We will pass Your Micro-Donations to the Charities chosen by Your Payment Service Provider. We do not represent or warrant that Your donations will be used for any particular purpose by the Charities You choose to support.

Your Data

  1. You agree that We can use Your Data in accordance with this Agreement. Our Privacy Policy forms part of this Agreement.
  2. You must notify Us immediately of any change of Your Data by updating Your Data in the Mobile App.
  3. You agree that We may communicate with You through the Mobile App, by email, or other electronic communication methods for issuing any service information about the Parsnip Service. We may send You something as a thank-you from time to time for using the Parsnip Service.
  4. You can tell Us if You want to receive marketing materials about new Rokami products and services when You register for the Parsnip Service, or at any point thereafter, using the Mobile App or the Website or Care.
  5. All Parsnip Service and Website content is owned by Rokami, Our associated third-party suppliers, Retailers, or the Charities, and is protected by Intellectual Property and trademark laws. No use of the Parsnip Service or the Website content is permitted without the express prior permission of Rokami, and, where applicable, the copyright or registered trademark holder.
  6. You agree not to misuse the Parsnip Service by introducing viruses, trojans, worms, logic bombs, or other material which is technologically harmful; attempt to gain unauthorised access to the Parsnip Service, the server on which the Parsnip Service are stored or any server, computer or database connected to the Parsnip Service; or attack the Parsnip Service via a denial-of-service attack or a distributed or malicious denial-of service attack.
  7. You agree to keep Your access details for use with the Parsnip Service confidential. You agree to notify Care immediately if You believe that such information is no longer secret. You agree not to permit any person to access the Parsnip Service for any unauthorised purpose that would constitute a breach of this Agreement.
  8. We reserve the right to modify or suspend all or any part of the Parsnip Service at any time with or without notice.
  9. We reserve the right to revoke Your access to the Parsnip Service without notice at any time if You fail to adhere to any of the terms set out in this Agreement.
  10. You have a right to receive an emailed electronic copy of the Data that We hold about You. For further information, please contact our Care team via email using care@getparsnip.com.

Our Liabilities

  1. We shall not be liable for any default resulting directly or indirectly from any cause beyond Our control, including the failure of data processing systems, or the failure of the systems of any of Our third-party suppliers.
  2. Where sums are incorrectly deducted by Your Payment Service Provider from the available balance on Your Payment Account, if it’s Our fault, Our liability shall be limited to reimbursing You with the amount incorrectly deducted.
  3. Nothing in this Agreement shall exclude or limit Our liability for death or personal injury resulting from Our negligence or fraud. To the extent permitted by law, all conditions or warranties implied by law, statute or otherwise are expressly excluded.
  4. Subject to clause 29, We shall not be liable for any loss of profit, business, contracts, anticipated savings, goodwill or revenue; any loss or corruption of data or software; any unavailability of the Parsnip Service resulting from a failure of any independent third-party telecommunications provider and or the internet; or any indirect or consequential loss or damage whatsoever.
  5. Subject to clause 29 and 30, Our total aggregate liability for all claims arising under or in connection with the Parsnip Service in respect of all events, regardless of form of action and whether in contract, tort, warranty, or other legal or equitable grounds (including in each case negligence) will be limited to one hundred pounds.
  6. We shall have no liability to You in the event of unauthorised Transactions arising out of negligence or fraudulent activity by You or someone using Your Payment Device with Your consent.
  7. The exclusions and limitations set out herein apply to any liability of Our third-party suppliers and any of their respective suppliers (if any), to You, which may arise in connection with this Agreement.

General

  1. Any delay or failure to exercise any right or remedy under this Agreement by Us shall not be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.
  2. If any provision of this Agreement is deemed unenforceable or illegal, the remaining provisions will continue in full force and effect.
  3. You may not assign or transfer any of Your rights and / or benefits under these terms. We may assign Our rights and benefits at any time without prior written notice to You. We may subcontract any of Our obligations under this Agreement.
  4. Nothing in these terms will reduce Your statutory rights.
  5. We may choose not to enforce or rely on one or more of these terms at any time, but We reserve the right to start applying them again at any time.
  6. This Agreement was published on the 1st November 2023.
  7. This Agreement supersedes and replaces all previous Agreements.
  8. We may change this Agreement from time to time by giving You at least a month’s notice before the changes take effect. When We make changes, We will inform You via email. You have the right to deregister from the Parsnip Service at any time before the changes come into effect. If You do not deregister from the Parsnip Service, You will be treated as having accepted the changes.
  9. This Agreement is governed by English law and You agree to the non-exclusive jurisdiction of the courts of England and Wales.

The Parsnip Service Privacy Policy

This Privacy Policy applies between You, the user of the Parsnip Service and Website, and Us, the provider of the Parsnip Service and Website. We take the privacy of Your Data very seriously. This Privacy Policy applies to Our use of any and all Data collected by Us or provided by You in relation to Your use of the Parsnip Service or the Website.

This Privacy Policy should be read alongside, and in addition to, Our Parsnip Service Terms and Conditions, and the Parsnip Service Cookie Policy.

Definitions

Appropriate Safeguards: means such legally enforceable mechanism(s) for transfers of personal Data as may be permitted under Data Protection Laws from time to time;

Care: means the help available to deal with Your Parsnip Service related queries. You may contact the Care team via email using care@getparsnip.com.

Cashback: as a Donor, when You complete a qualifying Transaction at a participating Retailer, You generate cashback, a cash benefit based on Your spend that is paid back to You;

Charity: means a charity registered with either the Charity Commission of England and Wales; the Charity Commission of Northern Ireland; or the Office of the Scottish Charity Regulator; and that has provided all the necessary documentation required to be deemed up-to-date by the Charity Commission;

Cookies: means a small text file placed on Your computer by Our Website when You visit certain parts of the Website and/or when You use certain features of the Website. Details of the Cookies used by Our Website are set out in the Parsnip Service Cookie Policy;

Data: means all the personal information that You submit to Us via the Parsnip Service and/or the Website. This definition incorporates, where applicable, the definitions provided in the Data Protection Laws;

Data Protection Laws: means any applicable law relating to the processing of personal Data, including but not limited to the Directive 96/46/EC (Data Protection Directive) or the GDPR, and any national implementing laws, regulations and secondary legislation, for as long as the GDPR is effective in the UK;

Donor: You become a Donor when You select a Charity to support and switch on Your Micro-Donations;

Donation-Boost: When You complete a qualifying Transaction at a participating Retailer, You generate a cashback donation, a cash benefit based on Your spend that You agree We can donate to Charity;

GDPR: means the General Data Protection Regulation (EU) 2016/679;

Gift-Aid: allows the charity(s) You support to do even more for society. Gift Aid is a UK government scheme that allows You to increase the value of Your Micro-Donations by 25% at no cost to You;

Micro-Donation: means the amount of money You agree to donate to Your supported Charities using the Parsnip Service when You complete a Transaction with a Retailer. You agree that Rokami can transfer Your Micro-Donations to Your selected charity(s);

Mobile App: means the mobile application provided by Your Payment Service Provider, that You use to access the Parsnip Service. Your Mobile App displays information about Your usage of the Parsnip Service, as well as allowing You to change Your Parsnip Service settings and preferences. You will need an active internet connection to access it;

Payment Device: means the payment card or ring, or some such other form-factor, provided by Your Payment Service Provider to effect Transactions;

Transaction: means a retail sale completed by You with a Retailer using Your Payment Device;

Rokami, We, Us, or Our: means Rokami Ltd whose registered office is St Michaels, Shinfield Road, Shinfield, Reading, Berkshire, England, RG2 9BE, or any of its wholly owned subsidiaries;

Website: means Our website getparsnip.com any sub-domains of this site unless expressly excluded by their own terms and conditions;

You: means the person entering into this Agreement with Us to access the Parsnip Service and/or the Website.

The Data We collect about You

  1. We may collect the following Data, which includes personal information, from You:
    1. Your name, address, phone number, date of birth, gender, email address, and an anonymous identifier from Your Payment Service Provider;
    2. Your account information: such as dates of Transactions, Transaction amounts, Micro-Donation amounts, Donation-Boost amounts, Cashback amounts, rewards redeemed, Your Gift Aid status, Your marketing preference status, or any other information related to Your account;
    3. Your contact with Us: such as an email or message that You send to Our Care team, or other records of any contact You have with Us;
    4. Your preferences for particular products, services, or lifestyle activities, when You tell Us what they are, and based on how You use Your Payment Device and the Parsnip Service;
    5. Your use of the Parsnip Service, Your browsing history within the Mobile App or Website, or Your interaction with an email that We send You. This may include details of Your operating system, location, IP address, browser ID, browsing activity, and other information about how You interacted with the Parsnip Service. We may collect this information as a part of the log filing process, as well as through the use of Cookies or other tracking technologies.
  2. We DO NOT store or at any time hold any bank sort code or account numbers or payment card numbers and security codes relating to Your bank account, credit card, or debit card.

When We collect Your Data

  1. We will collect Your Data when You:
    1. Register with Us and set up the Parsnip Service;
    2. Use the Parsnip Service;
    3. Subscribe to newsletters or alerts from Us;
    4. Ask Us for more information about the Parsnip Service;
    5. Elect to receive marketing communications from Us;
    6. Enter a competition or promotion;
    7. Redeem a Benefit;
    8. Share any part of the Parsnip Service on social media where the social media privacy rights in force allow this to occur;
    9. Leave a comment on one of Our blogs;
    10. Contact Us with a question or a complaint;
    11. Complete surveys that We use for research purposes (although You are not obliged to respond to them);
    12. Visit or browse Our Website or third-party supplier websites. We automatically collect some information about Your visit to the Website. This information helps Us to make improvements to Website content and navigation, and includes Your IP address, the date, times and frequency with which You access the Website and the way You use and interact with its content. We collect Your Data automatically via Cookies, in line with the settings on Your browser.
  2. We may also collect information about You from other organisations, if this is appropriate: these include fraud-prevention agencies, business directories, other companies, or Our third-party suppliers.

Using Your Data

  1. Our third-party suppliers may use, process, and analyse Your Data to:
    1. Provide the Parsnip Service to You;
    2. Offer You rewards and treats based on how You use the Parsnip Service;
    3. Process Your Micro-Donations and Donation-Boosts and transfer them from You to Your chosen Charities based upon the donation rules You have set;
    4. Process Your Cashback and instruct Your Payment Service Provider to transfer it to You;
    5. Respond to any questions or concerns You may have about using the Parsnip Service;
    6. Monitor the performance of Parsnip Service campaigns;
    7. Subject to You opting-in to receive marketing communications, occasionally keep You informed about new products and services from Rokami and carefully selected third-party suppliers;
    8. Understand how You use The Parsnip Service to develop more interesting and relevant products and services, as well as personalising the products and services offered to You;
    9. Carry out research and statistical analysis on an anonymous and aggregated basis based upon how You use the Parsnip Service;
    10. Provide anonymous aggregated trend analysis data-points to third parties (such reports do not contain any information which may identify You as an individual. An example data-point would be 460,000 individual donors give using the Parsnip Service);
    11. Prevent and detect fraud or other crimes, recover debts, or trace those who owe Us money.
  2. Your Data will be stored for as long as required by law in order to provide You with the Parsnip Service. Some of Your Data will be kept for a reasonable period after this Agreement has finished in case You decide to use the Parsnip Service again. You may be contacted during this time if You have opted-into receiving marketing communications from Us.
  3. In supplying this Data, You consent to this information being collected, used, disclosed, stored by Us, and if necessary to provide the Parsnip Service, transferred to Our third-party suppliers.
  4. Any comments or information that You supply on any blog that Rokami operates can be read, used or collected by anyone. If Your information appears in Our blog pages and You want it removed, please contact Our Care team via email using care@getparsnip.com.
  5. We maintain presences on social media platforms including Facebook, Twitter, and Instagram. Your interactions with these platforms are governed by the privacy policies of the companies that provide them. Anything You submit to Rokami via a social media platform is done so at Your own risk without any expectation of privacy.

Sharing Your Data

  1. We may share Your Data with:
    1. The Charities that You choose to support;
    2. The third-party suppliers that We use to provide You with the Parsnip Service;
    3. Fraud prevention agencies, law enforcement agencies, regulatory organisations, courts or other public authorities if We have to, or are authorised to by law, to facilitate the detection of crime or the collection of taxes or duties.
  2. To ensure that Your Data receives an adequate level of protection, We have put in place Appropriate Safeguards and procedures with the third-parties We share Your Data with. This ensures Your Data is treated by those third-parties in a way that is consistent with the Data Protection Laws. We may transfer Your Data to third-party suppliers in countries outside of the European Economic Area (EEA). This happens when Our third-party suppliers are based outside the EEA, or if You use the Parsnip Service while visiting countries outside of the EEA. We will only transfer Data outside the EEA where it is compliant with Data Protection Laws.
  3. We may, from time to time, expand or reduce the size of Our business. If We are reorganised or sold to another organisation, We may transfer Your Data to that organisation. We may also disclose Your Data to a prospective purchaser of Our business or any part of it. In these instances, We will take steps to ensure that Your privacy is protected.

Keeping Your Data secure

  1. We constantly review and improve measures to protect Your Data from unauthorised access, accidental loss, disclosure, or destruction. If You suspect any misuse or loss or unauthorised access to Your Data, please let Us know immediately by contacting Our Care team via email using care@getparsnip.com.
  2. Where We have contracts with third-party suppliers to provide Us with services to process Your Data, We ensure they have appropriate security measures in place, and only process Your Data in the way We have authorised them to.
  3. The Parsnip Service may contain links to enable You to visit other websites and apps of interest easily. We review all the other websites and apps before providing a link, however, these linked websites and apps are not under Our control and once You have used these links to leave Our Website or the Mobile App, You should note that We do not have any control over that other websites or apps. Therefore, We cannot be responsible for the protection and privacy of any information which You provide whilst visiting such websites and such websites are not governed by this Privacy Policy. You should exercise caution and look at the privacy statement applicable to the website or app in question. We advise You to examine the terms and conditions of using that website or app and its privacy statement. We do not make any representations about third-party websites or apps that may be linked to Our Website or the Mobile App.
  4. Communications over the internet (such as emails) aren’t secure unless they’ve been encrypted. Your communications may go through a number of countries before being delivered – as this is the nature of the internet. We can’t accept responsibility for any unauthorised access or loss of Data that’s beyond Our control.

How to access and control Your Data

  1. It is important that the Data We hold about You is accurate and current. Please keep Us informed if Your Data changes during the period for which We hold it. If You have any questions about the Data We hold about You, or if You believe We’re holding inaccurate information about You, please contact Our Care team via email using care@getparsnip.com so We can correct it.

Your rights

  1. Under the General Data Protection Regulation, You have a number of important rights, which include:
    1. the right to be informed;
    2. the right of access;
    3. the right to rectification;
    4. the right to erasure;
    5. the right to restrict processing;
    6. the right to Data portability; and
    7. the right to object.
  2. If You would like to exercise any of Your rights, please email Our Care team using care@getparsnip.com. In order to identify You, We’ll need to receive proof of Your identity and address (a copy of Your driving licence or passport and a recent utility or credit card bill), and You’ll need to let Us know what Data the request relates to.

How to make a complaint

  1. We will always try to resolve any query or concern You raise with Our Care team about Our use of Your Data. However, if You wish to lodge a complaint with the United Kingdom Information Commissioner under the General Data Protection Regulations, they may be contacted at https://ico.org.uk/make-a-complaint/.

Changes to this Privacy Policy

  1. This Privacy Policy was published on the 1st November 2023.
  2. We may change this Privacy Policy from time to time by giving You at least a month’s notice before the changes take effect. When We make changes, We will inform You via email. You have the right to deregister from the Parsnip Service at any time before the changes come into effect. If You do not deregister from the Parsnip Service, You will be treated as having accepted the changes.

If you’ve lost your ring or it has been stolen, please open the app on your mobile device and click to pause transactions immediately. This can be reversed if you find your ring.

If you do not have access to the app and are sure your ring is gone for good, please email us to cancel your ring. Please note, this action is non-reversible and will completely disable your ring forever.
